Terms and Conditions of Use for Mobile Applications by Nikolai Pliushchenkov

Please read these Terms and Conditions (hereinafter referred to as the "Terms") carefully before using the mobile application (hereinafter referred to as the "Application") distributed by Nikolai Pliushchenkov (hereinafter referred to as the "Developer," "We," "Our").
Your access to and use of the Application depends on your acceptance of and compliance with these Terms. These Terms apply to all individuals who access or use the Application.
By accessing and/or using the Application, you agree to abide by these Terms. If you do not agree with any part of the Terms, you are not authorized to access or use the Application and its provided services.
The download/purchase page of the Application may contain certain additional terms, conditions, and requirements that are part of the Terms of Service. If you download/purchase the Application through an app store such as Google Play Store, Apple App Store, or any other (hereinafter referred to as the "App Store"), please review the terms and conditions of that specific App Store, which may impose additional requirements applicable to downloading, installing, and using the Application.

1. License and Restrictions
Subject to these Terms, the Developer grants you a non-exclusive, non-transferable license to use the Application for your personal, non-commercial use. You are not permitted to modify, translate, reverse engineer, decompile, disassemble the Application, create derivative works, or use data extraction or collection tools in relation to the Application; reproduce, duplicate, copy, sell, resell, or otherwise exploit the Application, in whole or in part, for any purpose without our explicit written consent.

2. In-App PurchasesVirtual Currency and Items
The Application may include the ability to earn, purchase, or otherwise obtain virtual currency to access virtual items or goods. Virtual currency and virtual items are not real, have no monetary value, and cannot be exchanged for real currency or items. You do not own any virtual currency or virtual items. Virtual items or virtual currency cannot be transferred or resold in any way. The Developer reserves the right to change and/or limit the price, availability, expiration, or quantity of any virtual currency and/or virtual items without prior notice.

Subscriptions
The Application may offer you the option to purchase virtual currency and/or virtual goods through a subscription. By purchasing a subscription, you agree that:

The subscription fee will be charged to your selected payment method in the App Store (Google Play, Apple App Store, or another).
Your subscription will automatically renew each billing period until canceled by you or the Developer.
Subscriptions may be weekly, monthly, quarterly, semi-annual, annual, or seasonal. Payments for such subscriptions will be charged to your account upon purchase confirmation.
The subscription will be automatically renewed at the same price and duration as your initial subscription package unless you disable auto-renewal.
You can manage subscriptions and disable auto-renewal in your account settings after purchase.
Some of our subscription services may be offered on a free trial basis for a limited time. You can cancel such a subscription during the free trial period, otherwise, it will convert into a paid subscription.

Payments
When you pay for a subscription, purchase virtual currency and/or virtual goods, all payments are processed by the App Store (e.g., Google Play or Apple App Store). Please review your App Store’s payment terms for any additional payment conditions that may apply.
You agree that all payments for virtual currency, virtual items, and subscriptions within the Application are final. Refunds are processed according to the App Store policies.

3. Availability, Errors, and Inaccuracies
We regularly update our product and service offerings related to the Application. These products or services may be incorrectly priced, inaccurately described, or unavailable, and we may experience delays in updating information about the Application and in our advertisements on other websites.
We do not guarantee the accuracy or completeness of any information related to the Application, including prices, product images, specifications, availability, and services. We reserve the right to change or update information and correct errors, inaccuracies, or omissions at any time without prior notice.

4. External Links
The Application may contain links to third-party websites or services that are not owned or controlled by the Developer.
The Developer has no control over and assumes no responsibility for the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that the Developer shall not be responsible, directly or indirectly, for any damage or loss caused or alleged to be caused by reliance on any such content, goods, or services available on or through any such websites or services.
We strongly encourage you to review the terms, conditions, and privacy policies of any third-party websites or services that you visit.

5. Limitation of Liability
In no event shall the Developer, its employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, punitive, or other damages, including but not limited to loss of profits, loss of data, or loss of goodwill arising from (i) your access, use, inability to access, or inability to use the Application; (ii) any conduct or content of any third party related to the Application; (iii) any content obtained through the Application; and (iv) unauthorized access, use, or alteration of your data or content, whether based on warranty, contract, tort (including negligence), or any other legal basis, whether or not we were informed of the possibility of such damages, even if a remedy set forth herein has failed of its essential purpose.

6. Disclaimer
You use the Application at your own risk. Services related to the Application are provided on an "AS IS" and "AS AVAILABLE" basis, without any express or implied warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or contractual performance.
The Developer and its licensors do not guarantee that:

Any services related to the Application will function uninterrupted, secure, or available at any specific time or location;
Any errors or defects will be corrected;
Any services related to the Application are free of viruses or other harmful components;
The results of using the Application will meet your expectations.

7. Governing Law
These Terms are governed by and interpreted in accordance with the laws of Montenegro, without regard to conflict of law principles.
Failure by the Developer to enforce any rights or provisions of these Terms shall not be considered a waiver of those rights. If any provision of these Terms is deemed invalid or unenforceable by a court, the remaining provisions shall remain in effect. These Terms constitute the entire agreement between us regarding the Application and supersede any prior agreements we may have had regarding the Application.

8. Age Restrictions
Our Application is NOT intended for users under the age of 13. Thus, you are NOT allowed to use Our Application independently if you are under 13 years old. If you are between 13 and 17 years old or below the legal age of majority (depending on your region), you confirm that your parent(s) or legal guardian(s) have read and agreed to these Terms.
You are responsible for any actions and communications related to the Application, including transmitting, posting, and uploading information, as well as for the consequences of your interactions with the Developer.

9. Changes
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a change is significant, we will make an effort to provide notice at least 30 days before the new terms take effect. What constitutes a significant change will be determined at our sole discretion.
By continuing to access or use the Application and its related services after these changes take effect, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Services.

At the same time, the Developer is not obligated to accept unsolicited feedback, suggestions, or other information about the Application or any other aspects of its business. If you provide feedback or other ideas to the Developer, you agree that the Developer may freely use any feedback you provide for any purpose without compensation to you, including, but not limited to, improving its applications or services and creating derivative products.
